As Trail Set for October 17, Elon Musk files defense under seal
Twitter lawsuit against Elon Musk over a cancelled $44 billion buyout of the social media platform has been set for a five-day trial which would begin from October 17 in Delaware. Along with the billionaire who had filled his defense and counterclaims under the seal.

Delaware Chancery Court Judge Kathaleen St. J. McCormick had set the trial date when Musk’s lawyers wanted a start date from October 10 “without justification.” Twitter had mentioned that it has no opposition to October 17 until and unless it was assured of full five-day trial.
Meanwhile, Musk’s legal team had filed its formal answer and counterclaims to Twitter’s suit over the teetering transaction Friday, but the response was sealed. Under the chancery court rules, Musk would have five days during which he need to provide a redacted version of the filing.
McCormick had agreed earlier this month to fast-track the trial over Musk’s unsuccessful bid in order to acquire Twitter for $54.20 a share, that he had nixed over claims usage statistics for the social-media platform which was inflated by spam and robot accounts.
Twitter had claimed Musk, the world’s richest person, was dragging his feet on setting the schedule and lobbed a letter onto the court which was docket without even sharing it with his opponents. McCormick, in her eight-page order had warned both of the sides that any pre-trial information exchanges “should not be requested or withheld in an attempt to either inflict unreasonable demands or extract the unreasonable benefits from the opposition party.”
Twitter’s lawyers had mentioned that they would need only four days to prove Musk was misusing questions on spam and robot accounts as a pretext to run away from the deal. The company had mentioned that it would have turned over all its information about those accounts and it has been seeking to force the billionaire who had co-founded Tesla Inc., to consummate the acquisition.
Elon Musk had countered in court filings Twitter’s handover of the so-called bots material which has not been robust and mishandling of that data which provides a legitimate basis for his cancellation of the buyout.
