CCPA fined Amazon seller Cloudtail India for selling cookware outside of BIS standards.
For selling pressure cookers on Amazon in breach of the BIS regulations, the Central Consumer Protection Authority (CCPA) fined Cloudtail India 1 lakh. The regulatory body has ordered Cloudtail to recall 1,033 pressure cookers and pay back customers' money.
An official announcement claims that the CCPA, under the direction of Chief Commissioner Nidhi Khare, has issued a ruling against Cloudtail India Pvt Ltd. The Domestic Pressure Cooker (Quality Control) Order, 2020 specifies the norms.
The company was also compelled to pay a Rs. 1,000,000 fine for violating consumer rights and delivering residential pressure cookers to consumers in violation of the QCO's necessary guidelines.
When household pressure cookers were sold on e-commerce platforms in contravention of the law, the CCPA took immediate action against them. Major e-commerce sites including Amazon, Flipkart, Paytm Mall, Shopclues, and Snapdeal, as well as the merchants who had accounts there, had all received notification from the CCPA.
According to the statement, 'Amazon Basics Stainless Steel Outer Lid Pressure Cooker, 4 L (does not give pressure alarm by whistle)' is sold by Cloudtail India Pvt Ltd. On the Amazon e-commerce portal, buyers could purchase the pressure cooker.
In its response to the CCPA, Cloudtail stated that the import of the pressure cooker had been halted following the implementation of the QCO (Quality Control Order).
Although imports were halted, the company was still selling these pressure cookers to consumers, according to the CCPA. After receiving notice from the QCO, Cloudtail sold 1,033 units of pressure cookers through the Amazon e-commerce platform that did not meet the required specifications.
The CCPA has ordered Cloudtail to recall the 1,033 pressure cooker units it sold and repay customers for the cost of the recalled pressure cookers.
A compliance report must be submitted by Cloudtail in 45 days. The CCPA highlighted that failing to adhere to the requirements set forth by the QCOs not only jeopardises public safety but also exposes consumers to serious harm, including death.
Within 45 days, Cloudtail is required to produce a compliance report. The QCO violations, according to the CCPA, not only put the public's safety in danger but also put consumers at risk for serious harm, including death.
Additionally, the CCPA has issued safety alerts to inform and forbid customers from purchasing goods that lack a legitimate ISI mark and contravene BIS requirements.
The first safety alert concerned cooking gas cylinders, pressure cookers, and helmets; the second safety notice covered household items such as electric immersion water heaters, sewing machines, microwave ovens, and domestic gas burners with LPG, among other items.
