Punjab and Haryana HC Uses ChatGPT for Murder Bail Petition
The Punjab and Haryana High Court used ChatGPT, an OpenAI chatbot, on Monday to consider a bail plea. This appears to be the first time that ChatGPT has been used in an Indian court to assess the global viewpoint on bail jurisprudence.
Upon hearing a bail application, a bench of Judge Anoop Chitkara requested the chatbot's response. Jaswinder Singh, the alleged offender, was taken into custody in June 2020 on charges of rioting, criminal intimidation, murder, and criminal conspiracy. The defendant had applied to the HC for standard bail in the matter.
The Indian Express said that he was detained "due to involvement in a horrific attack carried out by him and his accomplices resulting in the murder of a person."
The court made it clear that any mention of ChatGPT was simply meant to offer a more comprehensive perspective on the bail jurisprudence and not to express a judgement on the case's merits.

The judges allegedly asked the AI tool, "What is the jurisprudence on bail when the assailants assaulted with cruelty," according to the Indian Express article. before deciding on the bail application.
The ChatGPT statement states that "the legal precedent on bail for situations where the attackers have assaulted with cruelty will rely on the individual circumstances of the case and the rules and regulations of the jurisdiction where the case is being heard." According to the report's statement of the HC's comprehensive order, this is the case.
The letter from ChatGPT also said that the attackers may be viewed as a danger to the community and a flight risk if they have been charged with a violent offence including cruelty.
To ensure that the offender shows up for court on time and doesn't endanger the public's safety, the judge may refuse to issue bail in such circumstances or impose an extremely high bond sum.
The statement further said that elements to be taken into account before granting bail include the gravity of the attack, the defendant's criminal history, and the evidence against
them.
